Legal service privacy notice

This privacy notice explains what information the council needs in order to deliver the legal service.

In order to provide this service, it is necessary for the council to collect, store and process personal data relating to customers. 

Safeguards are in place to ensure that this data is kept secure and the privacy of individuals is protected.

Who is responsible for your information?

Chesterfield Borough Council is the data controller for the personal information collected. 

Prosecutions

Purposes of processing your personal data

We need to process some personal information when we bring a prosecution case against an individual for breaches of regulatory law, or for housing repossession cases.

We may need to process information defendants and their associates, witnesses, victims and solicitors.

Categories of personal data and lawful basis

We may need to process some or all of the following categories of personal information:

  • contact details
  • age
  • National Insurance number and proof of identity
  • photos and CCTV footage
  • criminal convictions

Under data protection legislation, we are permitted to use your information this way because it is in our legitimate interests. In this case the council has a legitimate interest in building a case to enforce regulatory law in the public interest, or to reclaim possession of council housing.

Categories of sensitive personal data and lawful basis

We may need to process some or all of the following categories of sensitive personal information:

  • health information

Under data protection legislation, we are permitted to use your information this way because processing is necessary for the establishment, exercise or defence of legal claims.

Who we share your personal data with

We will share the information we process with external solicitors, both those representing the council and the defendant.

Purposes of processing your personal data

We need to process your personal information when you make an information request to us – this includes Freedom of Information Requests, Environmental Information Requests, subject access requests and other information rights requests under Data Protection legislation. We’ll use the information you provide about yourself to contact you about your request, and in some cases to identify the information you have requested.

We may need to process some or all of the following categories of personal information:

  • contact details
  • information about the services you receive or your relationship to the council

Under data protection legislation, we are permitted to use your information this way because we have a legal obligation to respond to these requests.

We won’t share this information with anyone else.

Purposes of processing your personal data

All our staff have a legal responsibility to report safeguarding issues and concerns. This may involve sharing personal information about services users, customers or tenants.

Categories of personal and sensitive personal data and lawful basis

We may need to process any personal or sensitive personal data. This processing is permitted under data protection legislation because we have a legal obligation.

Who we share your personal data with

The safeguarding leads in our service areas report issues and concerns directly to Derbyshire County Council. Please see the Derbyshire Safeguarding Children Board for more information about safeguarding reporting across Derbyshire.

Purposes of processing your personal data

We will need to process your personal information in order to communicate with you about your search request, and to take a payment.

Categories of personal and sensitive personal data and lawful basis

We will need to process some or all of the following categories of personal information:

  • contact details
  • payment details (if relevant, to pay for a search)

Our legal basis for this processing under data protection legislation is that it is carried out in the performance of a contract.

Who we share your personal data with

This personal data is not shared with anyone else without your explicit consent.
