Chesterfield Neighbourhoods PSPO - Public Spaces Protection Order

Chesterfield Borough Council, Derbyshire Police, and other Chesterfield Community Safety partnership members, have worked together to implement a new PSPO - Public Spaces Protection Order - in Chesterfield.

Mao of the Chesterfield Neighbourhoods PSPO areaThe aim of the new PSPO is to provide help and support to vulnerable members of the community, to address street drinking, nuisance begging, and anti-social behaviour using a vehicle.

The PSPO will see the council, police, and other partners including the community safety partnership, work together to address these issues. 

Breaching the PSPO is a criminal offence. Orders can be enforced by an officer authorised by the local authority (including police community support officers) and a police constable.

The location of the PSPO has been determined based on the communities and locations where consistent and sustained anti-social behaviour, street drinking, begging and car related ASB is occurring.

Now the PSPO is in place members of the community will see an increased high visibility presence within the area as officers and support staff conduct patrols, engage with the community, provide support and help to those who are homeless or rough sleeping and deter anti-social behaviour.

The Chesterfield Neighbourhoods PSPO bans:

  • urinating and defecating in public, except for within a recognised public toilet
  • loitering around shops or cash points for the purpose of begging
  • behaviour that causes nuisance, alarm, or distress to another person
  • stunts using a motor vehicle including doughnuts, skidding, handbrake turns and wheel spinning
  • loud music or noise from a vehicle that causes a nuisance to others
  • causing a danger or risk of injury to others by speeding or racing in a motor vehicle
  • causing an obstruction on a public highway, whether moving or stationary, including driving in convoy in a motor vehicle

The PSPO enables the police, or other authorised enforcement officers, to make anyone found drinking alcohol on the streets within the PSPO area hand over open or unopened alcohol tins or bottles.

Fixed penalty notice and offences

Anyone found to be in breach of the PSPO could be issued with a fixed penalty notice (FPN) and fined £100.

If unpaid, further action will be taken, which may include prosecution.
PSPOs may be enforced by any person authorised by Chesterfield Borough Council Officers, police officers and Police Community Support Officers.
